Futures and options trading involves substantial risk of loss and is not suitable for every investor. You may lose more than your initial investment. Only risk capital should be used for trading, and only those with sufficient risk capital should consider trading. Past performance is not necessarily indicative of future results.
1. What Holdfast software is
Holdfast products are chart-analysis software for NinjaTrader 8. They read market data and display it. That is the whole of what they do.
They do not:
- Provide investment advice or personalized recommendations.
- Generate buy or sell signals, or tell you when to enter or exit.
- Place, modify, cancel, or manage orders.
- Predict future price movement.
- Manage money, hold funds, or have any access to your trading account.
Every trading decision — whether to trade, what to trade, size, entry, stop, target, and when to stop for the day — is entirely yours, and you bear the full consequences of it.
2. We are not registered, and we are not your adviser
[ENTITY] is a software developer. We are not a registered investment adviser, broker-dealer, futures commission merchant, introducing broker, commodity trading advisor, or commodity pool operator, and we are not registered with the SEC, CFTC, NFA, FINRA, or any equivalent authority in that capacity.
Nothing on this website, in our documentation, in our emails, or in the software constitutes advice, a recommendation, or a solicitation to buy or sell any financial instrument. No fiduciary or advisory relationship is created by buying our software.
If you want advice about your own circumstances, consult a licensed professional who can take those circumstances into account. We cannot and do not.
3. Screenshots and examples are not performance results
The charts shown on this website are screenshots of the software running on live market data. They are included to show what the software displays, and nothing more.
- They are not a record of trades taken, and no trades are represented in them.
- They are not a representation of profit, loss, or trading performance, actual or hypothetical.
- They are not a claim that any account did, or would, achieve any particular result.
- They are selected to illustrate specific concepts. Other moments in the same sessions look different, including moments where a level did not hold.
No representation is made that any account will or is likely to achieve profits or losses similar to anything shown or described.
4. Hypothetical and simulated results
We do not publish backtested, simulated, or hypothetical performance results for our software, and you should be skeptical of anyone who does — including for our products, if you encounter such claims from a third party.
Hypothetical performance has inherent limitations. It is prepared with the benefit of hindsight, does not involve financial risk, and cannot account for the effect of real execution, slippage, liquidity, or the psychological pressure of trading actual money. There are frequently sharp differences between hypothetical results and the actual results subsequently achieved.
Note specifically that Holdfast Liquidity Levels cannot be backtested at all. Market depth is not stored historically the way price and volume are — the order book exists only in the live feed. Any product claiming historical depth-based levels is reconstructing them from a different kind of data.
5. Limitations you should understand before relying on it
It depends entirely on your data feed
The software displays what your data vendor sends. If your feed is delayed, incomplete, interrupted, or lacks the required order-by-order detail, the output will be wrong or absent. Data quality is between you and your vendor; we have no visibility into it and no control over it.
Levels build live only
Because depth is not historical, levels form only while the software is running and connected. Starting mid-session means missing everything that happened before you started.
Its outputs are characterizations, not facts about the future
Terms such as proven, absorbed, depleted, and exhausted describe what the order book and trade flow have already done, measured against thresholds and timers you configure. A level marked "proven" has met a duration test you set. It is not a guarantee that anyone will defend that price, and levels that absorb once are frequently taken out later.
Your settings change the output
Size thresholds, timers, reclaim windows, and chart interval all materially change what appears and what verdict it receives. The same session on two different configurations produces two different charts, and neither is more "correct" than the other.
Software has defects
All software does, including ours. Do not construct a strategy that fails catastrophically if an indicator displays something incorrectly or stops updating.
6. Proprietary trading firm accounts
If you trade a funded or evaluation account with a proprietary trading firm, that firm's rules — drawdown limits, permitted instruments, news restrictions, consistency requirements, data entitlements — are between you and them. Our software has no knowledge of those rules and will not stop you breaching one. Compliance is entirely your responsibility.
7. Your responsibility
By using Holdfast software you acknowledge that:
- You are solely responsible for your own trading decisions and their outcomes.
- You will not treat the software's output as advice, a signal, or a prediction.
- You have assessed whether futures trading is appropriate for your financial situation, experience, and risk tolerance.
- You are trading capital you can afford to lose entirely.
- You will comply with all laws and with the rules of your broker, data vendor, platform, and any proprietary trading firm.
Our liability is limited as set out in section 10 of the Terms of Service. We are not liable for trading losses.
8. If trading is causing you harm
Trading can become compulsive, and the losses are real. If you recognize yourself in that — chasing losses, trading money you needed for something else, hiding it from people close to you, or unable to stop when you have decided to — it is worth talking to someone.
The National Council on Problem Gambling runs a confidential 24/7 helpline in the US: call or text 1-800-522-4700, or chat at ncpgambling.org. Outside the US, your national health service or an equivalent local organization can point you to support.
We would rather lose a customer than have our software be part of that.
